Article 87 CISG



A party who is bound to take steps to preserve the goods may deposit them in a warehouse of a third person at the expense of the other party provided that the expense incurred is not unreasonable.


I.  Overview


Article 87 CISG is a specification of Articles 85 and 86 CISG in that it expressly provides for the possibility of storing the goods in a warehouse of a third person at the expense of the other party, unless the expense incurred is unreasonable. The provision serves as a clarification and did not raise any discussion at the Drafting Conference.
