If the price is fixed according to the weight of the goods, in case of doubt it is to be determined by the net weight.


I.  Overview


This article constitutes a rule of interpretation for determining the contract price. ‘Net weight’ means the total weight less the weight of packaging. The provision seldom causes difficulties. The rule is subsidiary; the parties’ intent (Art 6); practices which the parties have established between themselves; usages to which they have agreed (Art 9(1)); and commercial usages (Art 9(2)) prevail.
